1.1 General information about mandatory electronic invoices
Is it mandatory to use electronic invoices? The answer is YES. This is a government requirement. See below:In Clause 2, Article 35 of Decree No. 119/2018/ND-CP effective from November 1, 2018: “The organization of implementation of electronic invoices and electronic invoices with tax authority codes according to this Decree shall be completed for brazil data enterprises, economic organizations, other organizations, households and business individuals no later than November 1, 2020.”
However, recently, in Decree 123/2020/ND-CP, issued on October 19, 2020, the Government has adjusted the mandatory deadline for electronic invoices. Specifically, in Article 59 of Decree No. 123/2020/ND-CP:
Enterprises are required to switch to using electronic invoices when purchasing and selling goods and services from July 1, 2022.
So when is the expiration date for paper invoices ?
The exact last day to use paper invoices is June 30, 2022.
It can be seen that Decree 119/2018/ND-CP and the Law on Tax Administration 2019 are somewhat different in terms of the time of applying electronic invoices.
However, in general, these circulars and decrees do not overlap. The law in the 2019 Tax Administration Law is understood as the general content for electronic invoices and documents in general, including: contracts, requests, notifications, confirmations or other documents in the form of data messages issued by the parties related to the conclusion or performance of contracts.
